The Policy also sets forth how we use this information, provides other details about our personal information practices, and explains how to contact us if you have any questions or concerns. In addition to Jalapeno Tree, certain companies including, but not limited to, advertising, promotional, internet and public relations service providers (collectively, “Service Providers”) may assist Jalapeno Tree with respect to its websites. 1. Types of Information We Collect and How It Is Used.

Information You Give Us .

We only gather personal information, such as, first and last names, addresses and email addresses, when you voluntarily submit it to us or voluntarily apply for employment through the Website. For example, personal information may be collected from you in order to get your feedback on our Website and our products or to enter you in one of our contests or sweepstakes. You may choose not to provide the requested information, but in that event the Site or Mobile App may not function correctly or certain functions may not be available. Also, in the case of employment applications, we will only gather additional personal information that is necessary to process your application.

In addition, when you visit our Website, we may collect certain information by automated means. The information we collect may include your Internet Protocol (IP) address, computer/mobile device operating system and browser type, type of mobile device, the unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, the address of a referring website (if any), and the pages you visit on our Website. Mobile Devices and Location Information.

Mobile Apps and other mobile versions of our Website may collect precise information about the location of your mobile device using location awareness technologies such as GPS, Wi-Fi, Bluetooth or cell tower proximity. We use this information for location-based services that you request such as locating nearby Jalapeno Tree restaurants or identifying special offers that may be of interest to you or personalizing your interactions with Jalapeno Tree. For most mobile devices, you are able to withdraw your permission for Jalapeno Tree to acquire this information on your location through the device settings. If you have questions about how to disable your mobile device’s location services, we recommend you contact your mobile device service provider or the device manufacturer. If you would like us to delete location information we have collected, please contact us at the postal address listed below. Please note that the applications may not function properly following deletion, and that we may be required by law to retain certain information.

Use of Personal Information.

Jalapeno Tree or Service Providers acting on our behalf may use information collected from the Website visitors for any of the following purposes: (1) to send marketing and other communications to our visitors about our products or about the products and services of promotional partners that are not owned or affiliated with Jalapeno Tree; (2) to allow us to notify visitors of upcoming events, promotions, or activities on the Website; (3) to conduct internal reviews of the Website (i.e., to determine the number of visitors to the Website); (4) to help us better understand visitors’ use of the Website; (5) to fulfill prizes, awards and purchases; (6) to respond to specific requests from our visitors; (7) to provide any necessary notices and newsletters to our visitors; (8) to provide any necessary responses to comments or feedback received from our visitors; (9) to conduct marketing research; (10) to protect the security or integrity of the Website; and (11) in connection with inquiries regarding becoming an employee of a Jalapeno Tree restaurant. To opt out of emails, please follow the instructions in the email. You can stop any further collection of information by any Mobile Apps by uninstalling the Mobile Apps from your mobile device. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

2. Sharing of Personal Information.

We may share personal information within the Jalapeno Tree Family. The “Jalapeno Tree Family” includes Jalapeno Tree Operating LLC, our parent, our subsidiaries and our affiliates. Of course, any use of this information by the Jalapeno Tree Family will comply with this policy. Occasionally, with your permission, we will send marketing information to you, such as discount coupons, information about new product offerings, etc. If you do not elect to receive such materials, we will not send them to you.

Companies may be engaged by us to perform a variety of functions, such as, fulfilling orders, assisting with promotions, providing technical services for our Website. These companies may have access to personal information if needed to perform such functions. However, these companies may only use such personal information for the purpose of performing that function and may not use it for any other purpose.

We do not sell, transfer or disclose personal information to third parties outside the Jalapeno Tree Family. However, with your permission, we will, on occasion send marketing information on behalf of one of our business partners about products or services they provide that may be of interest to you. You may be asked if you wish to receive marketing materials from Jalapeno Tree business partners. If you elect to receive such materials, Jalapeno Tree will not share your personal information with such partners but rather will send a mailing or e-mail on behalf of the partners.

We reserve the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to protect the integrity of the Online Service, to protect and/or defend ourselves, our parent, subsidiaries, affiliates and agents in connection with any legal proceeding, to fulfill your requests, or to cooperate in any law enforcement investigation or an investigation on a matter of public safety.

Jalapeno Tree also reserves the right to transfer your personal information and usage data to a third party in the event of a transfer of all or substantially all of Jalapeno Tree’s assets to such third party. You will have the opportunity to opt-out of any such transfer if, in our discretion, the new entity plans to handle your personal information in a way that differs materially from this Privacy Policy.

3. Children’s Privacy Notice.

We understand the importance of privacy to visitors to and users of our Website. We are especially committed to protecting the privacy of children who visit or use our Website. Our Website is intended for users who are 18 years old or older. We do not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently received personal information from a child under the age of 13, we will delete such information from our records. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information without parental consent. Like most web sites, Jalapeno Tree uses cookies for a variety of purposes in order to improve your online experience. For example, we track the total number of visitors to our Website on an anonymous aggregate basis. We may also employ cookies so that we remember you when you return to the Site, to keep track of the items in your shopping cart if you purchase merchandise online, to administer certain contests and sweepstakes and to help customize your Jalapeno Tree web experience. Both we and others (such as out advertising networks) may collect personal information about our visitors’ online activities, overtime and across third-party web sites, when using our Website.

California Business & Professions Code Section 22575(b)(as amended effective January 1, 2014) provides that California residents are entitled to know how Jalapeno Tree responds to “Do Not Track” browser settings. Jalapeno Tree does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

6. Web Beacons.

A “Web Beacon” is an often-transparent graphic image that is placed on a web site or in an email to monitor the behavior of the user visiting the web site or sending the email. A web beacon is often used in combination with cookies.

We may use web beacons to count page visits by our users, to access our cookies, and otherwise to improve your experience on our Website. If you have registered to receive emails from us, we may also use web beacons in our emails to let us know which emails you have opened and acted upon, allowing us to gauge the effectiveness of our communications and marketing campaigns. We may offer links to sites that are not operated by Jalapeno Tree, however, we reserve the right to reject any request for a link to a third-party website and to remove any link for any reason. We are not responsible for the policies and practices of other companies, and any information you submit to those companies is subject to their privacy policies. Your access such third-party websites or content is at your own risk.

8. Other Jalapeno Tree Website.

All Jalapeno Tree Website operated by Jalapeno Tree will adhere to this Privacy Policy. The policies of some Jalapeno Tree Sites or Mobile Apps may vary, however, because of local customs, practices or laws or due to circumstances unique to that web site. In all cases, however, the Website operated by Jalapeno Tree will honor the commitments to our customers set forth in this Policy regarding the collection and use of personal information.

9. Opt-Out Procedures.

Emails

We hope that you value the email messages you’ve requested us to send you. However, if at any time you no longer wish to receive such marketing, promotional communications and/or other offers from us, you can “opt-out” by clicking unsubscribe in promotional email or mailing. In addition, information regarding opt-out procedures are provided in any promotional email we send to you.

It is important to keep the information you have provided to us up to date and accurate. Other personal information provided to us is not currently accessible online. 11. Changes to our Privacy Policy.

This Privacy Policy is effective as of the date set forth at the end of this Privacy Policy. From time to time, it may be necessary for Jalapeno Tree to change this Privacy Policy. If we change our policy, we will post the revised version here, so we suggest that you check here periodically for the most up-to-date version of our Privacy Policy. Any revised Privacy Policy will go into effect on the “Effective Date” shown in the revised Privacy Policy. However, we will not materially change how we handle previously collected information without providing notice and an opportunity to choose how we use that information. By continuing to use our Website, you consent to the terms and conditions contained in the Privacy Policy effective on the date you most recently accessed the Website.
